Nevada Supreme Court

The Nevada Supreme Court has ruled that language included in this year's state ballot Question 6 can stand.

The question concerns codifying abortion rights into the Nevada constitution, and a lawsuit had been brought to challenge its inclusion on the November ballot arguing that the question's description of effect was not legally sufficient.

According to court documents, Donna Washington and the Coalition for Parents and Children brought the suit, which also argued that the measure includes an unfunded mandate.

A lower court had previously ruled against Washington and the Coalition for Parents and Children.

In their ruling, the Supreme Court said "the description of effect states the initiative's purpose, to establish a constitutional right to abortion, and how that purpose is to be achieved, through a constitutional amendment."

The court also ruled that language in the question does not require appropriation or spending of money and does not require the state to pay for or provide abortions.

The court concludes its decision by agreeing with the district court, saying the measure does not implicate Article 19, Section 6 of the Nevada Constitution.
