The Washoe County District Attorney's Office says a Reno man was sentenced to 12 years in prison related a serious road rage incident involving a firearm last year.
Officials said 22-year-old Kelvin Torres pleaded guilty to two counts of assault with a deadly weapon and was sentenced to two consecutive six year sentences.
Additionally, he was on probation for a gross misdemeanor crime of challenge to fight at the time of the assaults.
The 12-year sentence was directed to run consecutive to a 364-day jail term on that prior conviction.
Torres must serve a minimum of three years in prison after he completes his jail sentence before parole eligibility begins.
The case began on October 18, 2020 when the Sparks Police Department responded to reports of shots fired in a road rage incident.
A victim reported being shot at multiple times while in the area of McCarran Boulevard and El Rancho Boulevard.
A Sparks Police Sergeant was the first arrive and he found the suspect, who had stopped to help associates in a car that had crashed.
When the sergeant contacted the suspect, Torres was standing in front of the crashed car along with another man. The sergeant saw two people were inside the car, along with a car seat in the back.
Based on the serious nature of the call, the sergeant ordered Torres and the other man to show their hands. Torres responded by taking out a handgun from his waistband and pointing it at the sergeant, who also drew his gun but did not shoot.
The sergeant, concerned his only line of fire included the crashed car's occupants and possibly the occupied car seat, chose not to fire at Torres.
Instead, he ordered him to drop the gun and waited for a muzzle flash in his direction.
Torres slowly lowered his gun as other officers began to arrive and eventually complied with commands to get on the ground where police arrested him.
Original Story, October 2020:
A road rage shooting incident turned into a major injury crash involving a protected person.
When responding to a road rage shooting call around 3:00 a.m. October 18, Sparks Police came across the involved vehicles in a crash nearby.
Upon arriving to the crash an officer exited their car just as Kelvin Torres, a person involved in the crash (pictured above), exited theirs- drawing a gun on the officer.Â
Within seconds another subject with Torres grabbed his arm and pushed the hand gun down. No shots were fired.
Torres was then taken into custody without incident for assault with a deadly weapon on a protected person.
It was later determined there was another suspect vehicle along with Torres' chasing the victims car. That car crashed into a guardrail on El Rancho near Wedekind. Two 23-year-old people were in the car sustained non-life-threatening injuries. A gun was found in that suspect car as well.
The victim vehicle was a truck with only the driver. The truck was hit with three bullets, the driver was not shot.Â
The investigation is ongoing.
