A judge in Reno will decide whether there's any reason to postpone a trial scheduled to begin in January for a 73-year-old Sparks man charged with murder in the shooting of an unarmed trespasser.
Washoe District Judge Patrick Flanagan earlier set Wayne Burgarello's trial for Jan. 20. But he's scheduled another status hearing in his courtroom at 9 a.m. Wednesday to consider any new concerns lawyers on either side might have.
Defense attorney Theresa Ristenpart told the judge last month she had not yet received all the evidence police collected from the vacant home where Burgarello is accused of killing one man and seriously injuring a woman in February.
Burgarello claims he acted in self-defense when he fatally shot 34-year-old Cody Devine in the home Burgarello owns in Sparks.
