Nevada Attorney General Aaron Ford has announced progress in a lawsuit he has joined with 22 other state attorneys general to challenge President Trump’s federal funding freeze.
On Monday, the White House Office of Management and Budget sent a nationwide memo directing states to freeze all federal grants and loans, which caused significant confusion across the country.
The Trump administration stated that the reason for the freeze was to reverse progressive steps taken regarding diversity, equity, and inclusion (DEI) efforts in federal programs, claiming it was not a sweeping directive.
The White House clarified that essential services like Social Security, food stamps, and federal student loans would not be affected by the freeze.
On Wednesday, less than two days after the memo was issued, the Trump administration rescinded the order.
A lawsuit was filed on Tuesday, January 28, by a coalition of 22 state attorneys general, including Ford. The lawsuit argues that a memo from the Trump administration violates the U.S. Constitution and federal law by imposing new conditions on previously awarded funding.
On Friday, Rhode Island Federal Judge John J. McConnell issued a temporary restraining order, agreeing with the states that the President overstepped his authority by overriding the policy decisions made by Congress. The judge stated that the President violated his duty to execute the laws passed by Congress by refusing to allocate the funds that Congress had appropriated.
In response to this initial legal victory, Attorney General Ford issued a statement, saying:
"The rollout of this disastrous and unconstitutional policy has been confusing and chaotic for millions of Nevadans and Americans. I have consistently said that I will defeat President Trump in court if he undertakes illegal or unconstitutional actions, and today's decision is an example of that. Today's victory is a win for the everyday Nevadan and for the rule of law."
According to officials from the Governor Joe Lombardo's office, nearly 32% of the governor's budget was impacted by the freeze.
