Washoe County District Attorney Chris Hicks says that Sparks Police were justified under Nevada law when they shot and killed Francisco Pena in 2022.
Authorities say Pena was shot and killed on August 22, 2022 after his estranged wife called police stating that Pena threatened her with a knife inside her apartment on Merchant Street.Â
The DA's office says the woman's son tried to take away the knife, but was cut in the process, while she ran to a neighbor's house to call 911.
Prosecutors say when officers arrived, they yelled at Pena to drop the knife but he refused, and that's when Pena was shot three times who then fell to the ground. He was transported to a nearby hospital where he later died.Â

The Sparks Police Department released body camera footage Thursday from an officer involved shooting that happened on August 22nd.Â
The suspect in that shooting, 59-year-old Francisco Pena, died from his injuries.
The video includes 911 audio from a woman who said her estranged husband was in her apartment and threatening her with a knife. She said her sons were also in the apartment, and that one of them had been injured when he tried to get the knife away from the suspect.
