Attorney: Wayne Burgarello Ready for January Trial

The lawyer for a 73-year-old Nevada man charged with murder in the shooting of an unarmed trespasser says he's ready to go to trial and anxious to prove he was acting in self-defense.

 

Defense attorney Theresa Ristenpart said Wednesday that after a month of repeated requests, Sparks police have finally agreed to let her view all the evidence from the vacant home where Wayne Burgarello is accused of killing one man and seriously injuring a woman in February.

 

She told Washoe District Judge Patrick Flanagan that means there's no need at this time to postpone the Jan. 20 trial date.

 

Ristenpart says she's confident the former school teacher acted in lawful, justified self-defense when he started shooting after he found the couple inside the rundown duplex he owns.  (AP)
