Donor Network West is taking legal action against a rival donor network, its foundation and Renown for contractual interference.
In a complaint filed December 8th, Donor Network West alleged breach of contract and intentional/tortious interference with contractual relationships against Nevada Donor Network and Nevada Donor Network Foundation.
The complaint alleges Las Vegas based Nevada Donor Network offered Renown Health $3 million in seed money for a new organ transplant program, an offer predicated on Renown Health naming Nevada Donor Network as its organ procurement organization.
The lawsuit says Donor Network West was then approached by Renown to make a similar contribution, which they declined.
The suit claims this chain of events violates the anti-kickback statute and that it goes against public policy prohibiting transplantable human organs for money.
The suit further states that an organ procurement organization needs federal approval to work with a hospital, and that only Donor Network West has that approval to work with Renown.
The suit further alleges that Nevada Donor Network has made misrepresentations and engaged in misconduct to create confusion and unrest among Donor Network West and affiliated hospital employees, and that it has made public misrepresentations concerning its status as a federally designated organ procurement organization.
