Instead he's asking a federal court to block two subpoenas. Black appeared this year in a broader House investigation into Epstein and others around him. Lawmakers said he refused to answer questions relating to nondisclosure agreements. They subpoenaed to force Black to appear for a sworn deposition Thursday. Black's lawyer, Susan Estrich, said the committee “ is on a fishing expedition that oversteps its authority.” The top Democrat on the committee called for Black to be held in contempt.

The swift action, without a formal roll call vote, refers the matter to the Justice Department to decide whether to seek criminal prosecution. The Oversight Committee had subpoenaed Black with a request to appear and to turn over any potential nondisclosure agreements involving the investigation into Epstein. Black’s lawyers have denounced the Oversight Committee’s pursuit of the former head of a private equity firm as an abuse of congressional power.
