Area apartment complexes and Waste Management of Nevada are seeking court approval for a settlement they have reached in a lawsuit against the waste disposal company concerning penalty fees.
The lawsuit, filed in April of 2019 by Sherwood Forest Apartments, Sierra Woods LLC, Bella Lago LLC, Lansdowne LLC, and Biggest Little Investments LP, alleged that Waste Management of Nevada used its position as a waste disposal monopoly in the area to charge penalty fees to commercial customers, while customers had no choice but to continue using their services.
The plaintiffs in the case sought restitution for overage fees paid to Waste Management for what the company referred to as overfull dumpsters.
On June 17, all parties involved in the lawsuit informed the court that they had reached a proposed settlement.
The settlement stipulates that the suit will be dismissed, and that Waste Management will establish uniform overage standards, provide warnings before assessing overage fees, issue notices of overage fees within 24 hours via email and through a mobile app, and provide a seven-day grace period between issuing a warning and assessing a fee.
Waste Management will also not charge overage fees for overages resulting from missed pickups.
Additionally, the plaintiffs in the case will receive $2,225,000 to reimburse attorneys’ fees and costs and for repayment of service awards.
