UPDATE, December 16, 2020:
Officials say OSHA citations issued to Douglas County and ABS Aviation for holding a rally in September were dismissed.
Two citations were issued following a President Trump rally at the Minden-Tahoe Airport on September 12. The citations were issued on October 23, based on alleged violations of Governor Sisolak's Declaration of Emergency Directive, prohibiting public gatherings of more than 50 people.
The OSHA violation penalties were for $2,950 and $2,603 respectively.
Douglas County and ABS Aviation formally contested both citations.
The dismissals will be formalized in settlement agreements and no formal complaints will be filed before the Nevada OSHA Board of Review.
The Douglas County District Attorney's Office represented both clients. The full dismissal of both citations was the result of several settlement conferences between OSHA representatives and the Douglas County District Attorney's Office. Arguments regarding selective enforcement, lack of evidentiary proof and several legal issues related to the First Amendment formed the basis for the DA's argument for dismissal.

Nevada OSHA has fined Douglas County and ABS Aviation for holding President Trump's Minden rally. OSHA says they held the event without prior approval from the state.
First, Nevada OSHA fined Douglas County and ABS Aviation for holding President Trump's rally in September.Â
Specifically, Douglas County was fined $2,950 and ABS Aviation in Minden for $2,603.Â
Nevada OSHA also issued a $2,603 fine to 95 Motorsports Complex, LLC in Fernley. OSHA says it held a September 21st public racing event without first submitting a plan for approval by the Division of Industrial Relations.Â
Nevada OSHA has issued a total of 175 notices of citation and penalty related to violations of required COVID-19 health and safety measures in effect since mid-March.
During the week beginning October 19, officials conducted 254 initial visits across the state at a wide range of business sectors finding an 88 percent compliance rate statewide, with 92% compliance in the north and 78% compliance in the south.
