NOVEMBER 5 UPDATE:

Lyon County Clerk/Treasurer Staci Lindberg has confirmed an issue involving the placement of a portion of Lyon County Precinct 26 in an incorrect Assembly District.

The confirmation comes after a statement issued Friday by the Nevada Secretary of State's Office.

In a release, the Lyon County Clerk/Treasurer's Office said that following a review, the portion of Precinct 26 was not redistricted as intended by the passage of Senate Bill 1 of the 2021 Special Legislative Session and remained in Assembly District 38, when it should have been moved to Assembly District 39.

"The Clerk’s Office is committed to fully investigating the details surrounding this issue," said the statement in part. "As this discovery was made during the conduct of the 2024 General Election, both the Lyon County Clerk/Treasurer’s Office and the Secretary of State’s Office have concluded that no meaningful changes can be made before the election closes."

According to the statement, the Legislature will review any dispute involving State Legislative seats. All impacted candidates have been informed of the situation.

Secretary of State Francisco Aguilar issued a statement on a redistricting discrepancy impacting some Lyon County voters.

In the statement, Aguilar says an investigation revealed that a portion of Lyon County Precinct 26 was not properly redistricted after the 2021 Special Legislative Session, and remained in Assembly District 38 when it should have been moved to Assembly District 39.

"Three total Assembly District candidates are on the 2024 General Election ballot for Assembly Districts 38 and 39," said the statement in part. "As this was brought to our attention during the conduct of the general election, there is no meaningful way to make any change prior to the election's close."

The Lyon County Clerk's office informed candidates of the improper redistricting Friday evening.

NRS 293.425 and 293.427 governs election contests for State Legislative seats and makes clear that any contest goes to the Legislature for review.
