Federal prosecutors in Texas announced assault charges against a Venezuelan delivery driver who was shot in the back by immigration enforcement agents Sept. 20. A federal complaint alleges 28-year-old Wilber Rafael Garces Perez tried to escape Immigration and Customs Enforcement, who pulled him over after a judge issued a final removal order, according to U.S. Attorney Justin R. Simmons for the Western District of Texas. If convicted Garces Perez faces up to 20 years in prison.
A Venezuelan delivery driver shot by an ICE agent in Texas has been ordered to remain jailed on charges of assaulting an officer. A judge ruled Wednesday that the case against Wilber Rafael Garces Perez can proceed after prosecutors showed body-worn camera footage of Garces Perez allegedly striking an ICE officer with his car mirror while trying to evade arrest in Austin. The defense argued the footage wasn't conclusive. The case has sparked renewed criticism of President Donald Trump's immigration crackdown. Garces Perez was making deliveries when officers pulled him over and he subsequently drove off, triggering a high-speed chase. He appeared in court in a wheelchair and his attorneys say he needs urgent medical care.
