Yerington Jury Rules Not Guilty in Toddler Murder Case

A jury in Yerington has found a Silver Springs man not guilty of two out of three charges after being accused of abusing and murdering his girlfriend's son. 

Cody Wallace was arrested and charged in connection with the death of Thomas O'Connell IV in November of 2010. 

Friday the jury returned to court less than 24 hours after closing arguments were made to announce their verdict. 

They found Cody Wallace not guilty of first degree murder, not guilty of manslaughter, but guilty of child abuse/neglect.

On Thursday prosecutors and defense attorneys presented closing arguments. 

"If the state hasn't shown you that Cody Wallace intentionally inflicted child abuse on Tom, you can't find felony murder," Wallace's defense attorney Paul Quade argued.

Jeremy Reichenberg, the Lyon County Chief Deputy District Attorney, pursuing the charges against Wallace argued that the "injuries are too widespread, too massive, too serious to happen from a normal fall."
