This week the Nevada State Senate will be working on a bill introduced my Chief Majority Whip Pat Spearman that deals with homeowner's associations.

SB 144 is designed to give homeowners some added protection if there's any kind of dispute with an HOA.

"We are currently in a non-judicial system," Senator Spearman said. "So for the homeowner, whatever the HOA tells you, that's it, there's no other place to go. What this bill would do is move from a non-judicial system to a judicial system."

It's a process, she says, that most industries have to contend with.

"If you get work done on your house and you don't pay the contractor, they have to go through the judicial system," she said. "What this bill will do for homeowners gives them a layer of due process they don't have right now."

The bill is set for work session this week. Senator Spearman says there's been some confusion about what the bill won't do.

"It does not take away the HOA's ability, if you're behind on your dues and your assessment, it does not take away their ability to start the process of liens and leading to foreclosure," she said. "It does not do that."

Senator Spearman says it would also give homeowners in foreclosure more time to try and get those homes back.

"Right now, it's 60 days right of redemption," she said. "On the 61st day, someone can buy your house if it was taken in foreclosure. If you couldn't pay the $1,500 or $2,000, how are you going to be able to get your house back in 60 days? So the judicial process will give them more than that. It's due process for the homeowner, that's all it is."

That bill is is work session, the senator hopes it will go to floor later this week.
