An elderly Idaho man has died after allegedly being pushed down onto an Amtrak train platform by another man on Wednesday evening, July 11, in Winnemucca.  

In a statement from the Winnemucca Police Department, they arrested Jacob Lee Pendleton of Cincinnati, Ohio originally for charges of abuse of an elderly person. 

Police say those charges were amended to open murder when the man injured, later died in the hospital, most likely from injuries that happened in his fall. 

Police say they were originally called to the Amtrak Station on West Railroad Street in Winnemucca for a medical assist call.

When officers arrived, they found Michael McClure of Caldwell, Idaho unconscious on the train platform. 

Police say according to witnesses another man waiting for a train to arrive pushed McClure down.

Officers found Pendleton and questioned and arrested him. 

McClure was taken to Humboldt General and later flown to St. Alphonsus Regional Medical Center in Boise, where he died. 

The Winnemucca Police Department is asking for anyone who was present on the train platform on July 10 and witnessed any part of McClure and Pendleton's interaction, to contact their office at (775) 623-6396.Â
