A lawsuit against Secretary of State Francisco Aguilar and Governor Joe Lombardo challenging Nevada law SB406 has been rejected by a higher court.

The suit alleges that some citizens felt like, acting in roles as election watchers or observers, they could not report suspicious activity at voting sites for fear that any reports would appear as intimidation towards election workers.

The U.S. Court of Appeals for the Ninth Circuit found that Robert Beadles and the other plaintiffs in the case have not established an "injury in fact" because they haven't alleged any credible threat of enforcement.

The court also said in their ruling that SB406 does not forbid any election observation activities that are authorized by Nevada law.

The court also found that a 2020 tweet by Nevada AG Ford that the defendants say threatened the plaintiffs with enforcement of SB406 couldn't have been possible because SB406 did not exist in 2020.

In addition, they found that the tweet "threatened to prosecute voter intimidation, not the intimidation of election officials."

The court goes on to say that the plaintiffs have not alleged that either Aguilar and Lombardo, the defendants, have the authority to enforce SB406 so the suit is not necessarily targeted at the right people.
