The Nevada Democratic Party is taking legal action to prevent independent presidential candidate Robert F. Kennedy Jr. from appearing on November's ballot.

In the lawsuit against RFK Jr. and the Nevada Secretary of State, Nevada Democrats argue that Kennedy's affiliation with other political parties violates Nevada election rules for independent candidates.

Kennedy has accepted various minor party nominations in different states to get on the ballot in those states.

However, Nevada electoral rules hold that independent candidates not to be affiliated with other parties.

It's not Kennedy's first legal roadblock to getting on Nevada's ballot.

The campaign presented over 15,000 signatures in January—more than the required number —but in early March, the secretary of state's office told them that their ballot petition had been disqualified due to an employee of the secretary of state's office giving the campaign inaccurate guidance.

"Those petitions had Bobby Kennedy's name at the top. Then the state, which the state said was all we needed to do, they said oh, we forgot to tell you that you have to have a VP on it also, and it's like, well, you know you can't change the rules now," said Steve Mezak, a volunteer for the Kennedy campaign in Northern Nevada.

Now, the campaign is re-collecting signatures. We spoke to an undecided voter who stopped the campaign's booth at the Nevada State Fair.

"I do think it's fair that Mr. Kennedy gets on the ballot and gets a chance to say what he feels is the thing for America, like anybody else should have a fair shot at it," said Dayton resident Rudolph Serna.

While Secretary of State Cisco Aguilar acknowledged his office's mistake, he also told us that they cannot make exception to Nevada electoral rules. 

"We're not going to pick and choose how we implement the law and how we follow statute, the secretary of state is a regulator. It is our job to call balls and strikes. It is our job to ensure that Nevada has the safest and most secure elections in the country," explained (D) Nevada Secretary of State Cisco Aguilar.

On Saturday, the RFK Jr. campaign gathered signatures at the DMV in Reno.

On Sunday morning, canvassers will be at the Riverside Farmers Market at Idlewild Park from 8 to 11 ama.m.

On Monday, RFK Jr. Volunteers will have a booth at the DMV in Reno from 8 am to 5 pm throughout the week.
