The Nevada Dept. Of Corrections has announced a two-step verification process to prevent miscommunications or oversights when housing inmates between different law-enforcement agencies.
NDOC says it is retraining staff when sending an inmate to a new jurisdiction to include a memo stating the offender must be returned to the NDOC before release. Periodic reviews will also be conducted to ensure the inmate remains in custody, and a reminder will be sent to that jurisdiction not to release the offender.
The state says the protocol comes after Jeremy Kelly, 64816, was released from federal custody without being reinstated on his parole from the NDOC.
Kelly was admitted to NDOC on March 30, 2000, with an aggregated sentence of 40 years to life for conspiracy to commit robbery and/or murder, burglary while in possession of a firearm and/or deadly weapon, murder with use of a deadly weapon, and robbery with use of a deadly weapon.
Because Kelly was 15 at the time of the crime, he was eligible for parole after 20 years, as outlined in AB 267. He was granted parole in 2016 and released on parole on July 15, 2016. He was then returned to NDOC custody on parole violation on Jan. 29, 2018. The Nevada Parole Board revoked his parole until March 1, 2021.
On March 15, 2018, he was transferred from High Desert State Prison to Clark County Detention Center for a scheduled court hearing and ultimately taken into custody by the Federal Bureau of Prisons. When CCDC was contacted by Bureau of Prisons in 2022, there was no memo on file, and he was released on his Federal Probation. During a routine audit, the NDOC determined he had not been seen for parole reinstatement in 2021.
Kelly remains on Federal Probation and will appear before the Nevada Parole Board during its April meeting.
